Terms of Service

These Terms of Service ("Terms") govern your use of risecite.com and the RiseCite AI-visibility service (the "Service"), operated by HERC PRIME DOO ("RiseCite", "we", "us"), a company registered in Serbia — full company details available on request via hello@risecite.com. By using the Service you agree to these Terms.

1. The Service

RiseCite measures how often AI engines (such as ChatGPT, Perplexity, Gemini and Claude) mention, recommend and cite brands in response to buyer questions, and provides scores, competitor comparisons and improvement recommendations. The Service includes a free audit, paid subscription plans and optional done-for-you services ("Teardown" and "Boost").

2. Free audits and reports

• Free audits are provided as-is, for informational purposes, and may be limited in the number of questions, engines and runs.
• Results reflect the responses of third-party AI models at the time of the audit. AI outputs are inherently variable: the same question can produce different answers at different times.
• Reports and recommendations are professional guidance, not a guarantee that any AI engine will mention, cite or recommend your brand.

3. Accounts

Paid plans require an account. You are responsible for keeping your credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.

4. Acceptable use

• Only audit brands and domains you are authorized to represent, or public brands for lawful competitive research.
• No automated mass submission of audits, scraping, or attempts to circumvent rate limits or access controls.
• No use of the Service to build a competing dataset or product.
• No unlawful, misleading or abusive use, and no interference with the Service's operation.

We may suspend or terminate access that violates this section.

5. Plans, fees and billing

• Subscription fees are stated in EUR and exclude VAT and other applicable taxes.
• Plans are billed monthly or annually in advance. Annual billing carries the discount shown at purchase.
• Subscriptions renew automatically at the end of each billing period unless cancelled beforehand.
• You can cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
• We may change prices with at least 30 days' notice; changes apply from your next billing period.

6. Done-for-you services

Teardown and Boost engagements are described in the applicable order or statement of work. Deliverables, timelines and fees are as agreed there; these Terms apply to anything not covered by the order.

7. Intellectual property

• The Service, including its software, scoring methodology and content, remains our property.
• Your inputs (brand details, questions) remain yours. You grant us a license to process them to provide the Service.
• You may use reports internally and share them within your organization or with your clients; you may not resell RiseCite reports as a standalone product except under an Agency plan.

8. Third-party AI engines

The Service queries third-party AI models operated by OpenAI, Anthropic, Google, Perplexity and others. We are not affiliated with these providers and are not responsible for their outputs, availability or policy changes. Engine coverage may change if a provider materially alters access or pricing.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the Service will be uninterrupted or error-free, or that following recommendations will produce any particular visibility outcome.

10. Liability

To the maximum extent permitted by law, our total aggregate liability arising out of or related to the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental or consequential damages, or for loss of profits, revenue or data. Nothing in these Terms limits liability that cannot be limited by law.

11. Termination

You may stop using the Service at any time. We may suspend or terminate the Service for material breach of these Terms, with notice where practicable. Sections that by their nature should survive (IP, disclaimers, liability) survive termination.

12. Governing law

These Terms are governed by the laws of the Republic of Serbia, excluding its conflict-of-law rules. The competent courts of the Republic of Serbia have exclusive jurisdiction, without prejudice to mandatory consumer protections in your country of residence.

13. Changes to these Terms

We may update these Terms as the Service evolves. Material changes will be announced on this page — and by email to customers — at least 14 days before taking effect. Continued use after that date constitutes acceptance.
